Imagine you are 12 years old again and dependent on leg orthoses. You want to use a playground with your friends, but you can only get close to the equipment. All the play equipment is in the sand, you can’t reach the slide and the climbing frame because the rungs are too high.

The examples can go on and on: for visually impaired people, there are usually no tactile or visual guidance elements to help them find the equipment or avoid running into swing zones. If a child is injured, they may need help. However, if I’m in a wheelchair and can’t reach the child because the planners haven’t thought of everyone, I don’t even visit a typical German playground.

We at natürlich inklusiv want to create playgrounds for everyone.

We create individual playgrounds and work independently of manufacturers. This saves you having to search for suitable, proven and low-maintenance equipment. Above all, however, we use what is really needed. A concept for your institution, your location and the users must be sustainable.

Planning & concept

We provide you with individual and, above all, manufacturer-neutral advice, tailored planning, several drafts and drawings. The design drawing is the basis for a smooth implementation of the project, for well thought-out funding applications and a sustainable concept.

As a link between all trades and parties involved, we are committed to transparent communication – from the start of the idea to implementation and acceptance. Our collaboration with you, architects, gardening and landscaping companies, fall protection manufacturers, equipment suppliers, financiers and other stakeholders is fully documented to guarantee traceable working methods.

Funding acquisition

We research suitable funding for you, develop funding concepts and submit applications to foundations, sponsors, state and federal institutions. We also use social platforms to acquire donations or support you in the implementation of crowdsourcing projects.

6. Custom Services

Handling applicant data

We offer website visitors the opportunity to submit job applications to us (e.g., via e-mail, via postal services on by submitting the online job application form). Below, we will brief you on the scope, purpose and use of the personal data collected from you in conjunction with the application process. We assure you that the collection, processing, and use of your data will occur in compliance with the applicable data privacy rights and all other statutory provisions and that your data will always be treated as strictly confidential.

Scope and purpose of the collection of data

If you submit a job application to us, we will process any affiliated personal data (e.g., contact and communications data, application documents, notes taken during job interviews, etc.), if they are required to make a decision concerning the establishment or an employment relationship. The legal grounds for the aforementioned are § 26 BDSG according to German Law (Negotiation of an Employment Relationship), Art. 6(1)(b) GDPR (General Contract Negotiations) and – provided you have given us your consent – Art. 6(1)(a) GDPR. You may revoke any consent given at any time. Within our company, your personal data will only be shared with individuals who are involved in the processing of your job application.

If your job application should result in your recruitment, the data you have submitted will be archived on the grounds of § 26 BDSG and Art. 6(1)(b) GDPR for the purpose of implementing the employment relationship in our data processing system.

Data Archiving Period

If we are unable to make you a job offer or you reject a job offer or withdraw your application, we reserve the right to retain the data you have submitted on the basis of our legitimate interests (Art. 6(1)(f) GDPR) for up to 6 months from the end of the application procedure (rejection or withdrawal of the application). Afterwards the data will be deleted, and the physical application documents will be destroyed. The storage serves in particular as evidence in the event of a legal dispute. If it is evident that the data will be required after the expiry of the 6-month period (e.g., due to an impending or pending legal dispute), deletion will only take place when the purpose for further storage no longer applies.

Longer storage may also take place if you have given your agreement (Article 6(1)(a) GDPR) or if statutory data retention requirements preclude the deletion.

Allgemeine Geschäftsbedingungen (AGB)

§ 1 Geltungsbereich

Die folgenden AGB gelten für sämtliche Leistungen, die das gemeinwohlorientierte Planungsbüro Burkhard Küthe, natürlich-inklusiv (im Folgenden “Auftragnehmer”) erbringt, sofern nicht im Einzelfall ausdrücklich etwas Abweichendes vereinbart wurde.

§ 2 Leistungen

§ 2.1 Planungsleistungen

Der Auftragnehmer bietet Planungsleistungen für inklusive Spielplätze an und legt besonderen Wert auf Service und Nachhaltigkeit. Hierbei wird besonders auf die Barrierefreiheit und die Bedürfnisse von Menschen mit Behinderungen geachtet. Der genaue Umfang der Leistungen wird im Einzelfall zwischen Auftraggeber und Auftragnehmer vereinbart.

§ 2.2 Fördermittelakquise

Der Auftragnehmer erbringt Dienstleistungen im Bereich der Fördermittelakquise. Der Auftraggeber beauftragt den Auftragnehmer, Fördermittel für ein bestimmtes Projekt oder Vorhaben zu akquirieren.

§ 3 Vergütung

§ 3.1 Vergütung von Planungsleistungen

Die Vergütung richtet sich nach der vereinbarten Leistung und wird vor oder nach Abschluss der jeweiligen Leistung abgerechnet. Der Auftragnehmer behält sich vor, angemessene Vorschüsse zu verlangen.
Die Vergütung wird fällig, nach Rechnungsstellung der erfolgten Teilleistung oder Leistung.

§ 3.2 Vergütung für Fördermittelakquise

Stellt der Auftragnehmer im Falle einer erfolgreichen Förderung eine prozentuale Beteiligung in Rechnung, so wird der Rechnungsbetrag nach schriftlicher Bewilligung des Förderantrages zur Zahlung fällig. Die Fälligkeit der Zahlung tritt unabhängig von der tatsächlichen Umsetzung des Projekts ein. Dies gilt auch, wenn das Projekt nicht umgesetzt wird oder werden kann, beispielsweise aufgrund einer Rücknahme des Auftrags durch den Auftraggeber oder der Nichtbewilligung eines oder mehrerer erforderlicher Förderanträge, die eine Umsetzung des Projekts verhindern.

§ 3.3 Vertragsbruch und vorzeitiger Maßnahmenbeginn

Im Falle eines Vertragsbruchs oder vorzeitiger Maßnahmenbeginn des Auftraggebers, die den vereinbarten Leistungsumfang beeinträchtigen oder verändern, ist der Auftraggeber verpflichtet, dem Auftragnehmer sämtliche entstandenen Kosten zu erstatten. Die Vergütung für die bereits erbrachten Leistungen bleibt hiervon unberührt.

§ 3.4 Vergütung für Fördermittelhinweise

Beantragt der Auftraggeber selbst Förder- / Stiftungsgelder oder Spenden und kommt der Hinweis auf den Namen der fördernden Institution vom Auftragnehmer, so erhält der Auftragnehmer für jeden erfolgreichen Hinweis 3% der bewilligten Summe.

§ 4 Zahlungsbedingungen

Die Rechnungsstellung erfolgt zum Zeitpunkt der Halbzeit des Leistungserbringungszeitraums. Die Vergütung ist nach der Rechnungsstellung fällig und zahlbar sofort ohne Abzug. Bei Zahlungsverzug ist der Auftragnehmer berechtigt, Verzugszinsen in Höhe von 5 % über dem jeweiligen Basiszinssatz zu verlangen. Wir behalten uns außerdem vor, im Falle von Zahlungsverzögerungen die Erbringung weiterer Leistungen auszusetzen.

§ 5 Haftung

Der Auftragnehmer haftet im Rahmen der gesetzlichen Vorschriften für vorsätzlich oder grob fahrlässig verursachte Schäden. Für leichte Fahrlässigkeit haftet der Auftragnehmer nur bei Verletzung wesentlicher Vertragspflichten. Die Haftung für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit sowie nach dem Produkthaftungsgesetz bleibt unberührt.

§ 6 Geheimhaltung

Der Auftragnehmer verpflichtet sich, alle im Rahmen des Auftrags bekannt gewordenen Informationen vertraulich zu behandeln und nicht an Dritte weiterzugeben, es sei denn, der Auftraggeber hat hierzu ausdrücklich seine Zustimmung erteilt oder der Auftragnehmer ist gesetzlich zur Weitergabe verpflichtet.

§ 7 Urheberrecht

Sämtliche Urheberrechte an den von dem Auftragnehmer erstellten Planungsleistungen verbleiben beim Auftragnehmer. Eine Weitergabe an oder Verwendung durch Dritte, auch innerhalb einer Institution/Konzern des Auftraggebers, bedarf der ausdrücklichen Zustimmung des Auftragnehmers.

§ 8 Datenschutz

Der Auftragnehmer verpflichtet sich, die Bestimmungen des Datenschutzes einzuhalten und personenbezogene Daten nur im Rahmen der Vertragsdurchführung zu verarbeiten.

§ 9 Vertragsdauer und Kündigung

§ 9.1 Vertragsdauer und Kündigung bei der Fördermittelakquise

Der Vertrag wird für die im Angebot vereinbarte Laufzeit geschlossen. Eine Kündigung ist nur aus wichtigem Grund möglich. Ein wichtiger Grund liegt insbesondere vor, wenn eine Partei ihre vertraglichen Pflichten schwerwiegend verletzt.

§ 10 Schlussbestimmungen

Es gilt das Recht der Bundesrepublik Deutschland. Erfüllungsort und Gerichtsstand ist, soweit gesetzlich zulässig, der Sitz des Auftragnehmers. Sollten einzelne Bestimmungen dieser AGB unwirksam sein oder werden, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt. Anstelle der unwirksamen Bestimmungen tritt eine Regelung, die dem wirtschaftlichen Zweck der unwirksamen Bestimmung am nächsten kommt.
